1. General Provisions

1.1. These Terms (hereinafter referred to as the Terms) constitute an offer by ODAK Group LLC (hereinafter referred to as FOXIZZ) to an Internet user (hereinafter referred to as the User) to use the FOXIZZ service (hereinafter referred to as the Service).

1.2. The User's use of the Service is governed by these Terms, as well as:

- User Agreement

- Privacy Policy

- Rules for the use of promotional codes

- Rules for the referral program for users of the service

1.3. Starting to use the Service / its individual functions, the User is considered to have accepted these Terms, as well as the terms of the Regulatory Documents, in full, without any reservations or exceptions.

If the User does not agree with any of the provisions of the Terms and/or Regulations, the User is not entitled to use the Service.

1.4. FOXIZZ has the right to change the provisions of these Terms at any time without notifying the User, and ODAK Group LLC has the right to change the terms of the Regulatory Documents at any time without notifying the User.

1.5. If FOXIZZ, in the prescribed manner under these Terms, clause 1.4. made any changes with which the user does not agree, he is obliged to stop using the service․

1.6. The Service offers the User a free opportunity to post information about the User's potential demand for passenger transportation services and other services.

1.7. Depending on the city or region of the User, all or some of the functions of the Service may be unavailable or limited. Functions are considered inaccessible (limited) for a User from a certain city or region, if such User cannot use them explicitly.

The use of any technical and software methods to circumvent these restrictions is prohibited.

The provisions of these Terms governing the functions of the Service that are inaccessible (limited) for the User shall not apply until such functions become available to the User in an explicit form.

1.8. By using the Service, the User agrees to receive advertising messages. The User has the right to refuse to receive advertising messages by using the corresponding functionality of the Service or by following the instructions specified in the received advertising message.

1.9. All customer support conversations may be recorded for quality control and service purposes.

1.10. FOXIZZ and/or involved third parties have the right to collect opinions and feedback from Users on various issues of the Service for statistical purposes, to control the quality of the services provided, and also use the received data in depersonalized form for the operation of the Service.

A survey of Users can be conducted by sending an informational message or communicating using the contact information specified by the User in the account (via phone calls or emails).

1.11. Depending on the city or region, additional insurance for passengers and drivers is valid during the trip.

1.12. FOXIZZ may temporarily or permanently restrict the provision of the Service to the User without giving reasons, including in case of violation by the User of these Terms, receiving repeated complaints about the actions of the User.

2. Use of the Service

2.1. The Service is provided to the User for personal use.

2.2. Information about the transportation of passengers and other services (hereinafter referred to as "Information") is provided by drivers registered with the Service, service providers and shops.

For more detailed information about the services offered (including information about the availability of a wi-fi access point in the cabin, about the photo / video fixing in the cabin by FOXIZZ drivers and other information), the User can either contact the Service Partners - drivers, service providers or stores or, using the functionality of the Service, provide their contact details, by which the Partners can independently contact the User and provide him with information about the services offered.

2.3. The User may have access to the functions of evaluating Service Partners, as well as posting comments/reviews about the Service and/or the services of the Service.

Ratings and reviews of Users are posted in the Service application, and may also be available on third-party websites.

FOXIZZ reserves the right to refuse to post any rating/review, as well as to delete/block the rating/review posted by the User at any time at its own discretion and without giving reasons.

2.4. FOXIZZ reserves the right, at its sole discretion, to restrict the User's access to the Service (or to certain functions of the Service, if technologically possible) using his account or completely block the User's account in case of repeated violation of these Terms, or take other measures against the User in order to compliance with the requirements of the law or the rights and legitimate interests of third parties.

2.5. During periods of increased demand for transport services (including pre-holiday days, days of mass events and in other cases), tariffs may be increased. FOXIZZ informs about the increase in tariffs by posting an appropriate notice on the Service website or by other means at the discretion of FOXIZZ, including sending an information message to the User's mobile phone number.

2.6. Services for the transportation of passengers of the presented cars are carried out for different classes of cars. The assignment of a car to one or another class is carried out on the basis of data on the characteristics of the car provided by drivers.

2.8. The Driver and/or service provider may charge a fee for the User's refusal to complete the trip/service, if such refusal occurred after the acceptance of the Driver and/or service provider of the order.

The amount of such a fee is calculated similarly to the cost of the trip / service at the rate for the period of time from the moment the car is actually delivered to the place of delivery or from the moment of delivery specified in the information provided to the User.

The User cancels the trip/service by sending a corresponding notice to the Driver through the Service.

The User who did not board the given car within 30 (thirty) minutes and/or did not provide the cargo for transportation and/or did not provide the parcel for courier delivery, if this is provided for as part of the provision of transport and other services by the Driver, taking into account the waiting time specified in the relevant tariff is considered to have refused the trip of the service, unless otherwise provided, or by agreements between the User and the Driver.

The fee for the User's refusal to make a trip from the airport is calculated in the manner indicated above, with an additional fee for the delivery of the car out of town according to the tariff.

2.9. The User gives FOXIZZ consent to the processing of personal information (including personal data) of the User or the person in respect of which the User places information through the Service on the potential demand for passenger transportation services and / or other services, or the person whose information the User has specified in accordance with section 5 of these Terms or indicated as a contact person (recipient) when registering other services, to the transfer of such personal information by FOXIZZ to companies belonging to the same group of persons with FOXIZZ, Drivers, as well as to the processing of such personal information by companies belonging to the same group of persons with FOXIZZ, Drivers, for the purpose of providing the User or the person specified by the User with the Service.

The User understands and agrees that in the case when the User is a member of a joint account in accordance with these Terms and makes a trip as a result of posting information about his potential demand through the Service using the FOXIZZ program for mobile devices, then information about such a trip also becomes available to the person created such a joint account.

The User guarantees that it is authorized to provide personal information of the person in respect of which the User places information through the Service on the potential demand for passenger transportation services or other services for the purposes specified in this clause, and the person whose information the User has indicated in these Terms.

When the User uses the Service, the specified personal information is transferred to ODAK Group LLC (OGRN: 1057747090268), for processing on the terms and for the purposes specified in the Privacy Policy of ODAK Group LLC, available for review at: https:/ /foxizz. com/legal/privacy.

2.10. If the User orders the courier delivery service, the User undertakes not to hand over the following items for delivery:

  • Narcotic drugs, psychotropic, potent, toxic, radioactive, explosive, poisonous, caustic, flammable and other dangerous substances, including those under pressure;
  • Firearms, pneumatic, gas or edged weapons and their parts, ammunition, fireworks, flares and cartridges;
  • Foreign currency and banknotes
  • Precious metals, precious stones and products containing them;
  • Items and substances that, by their nature or due to packaging, may pose a danger to people, pollute or spoil (damage) other goods, surrounding people or objects;
  • Animals and plants, biological materials;
  • Items requiring specially equipped vehicles for transportation, including food products;
  • Liquids in open containers;
  • Large-sized items, the sum of measurements of which (except as otherwise provided) in length, width (two diameters or axes at the base of the roll) and height exceeds 150 cm, long items, the length of which is over 150 cm; The weight of transferred items cannot exceed 20 kg. In the case of ordering a courier delivery service by a foot courier, the size of the transferred items (width, length, height) cannot exceed 50x50x50; the weight of transferred items cannot exceed 10 kg;
  • Fragile items without special packaging;
  • Any other items, the circulation of which is prohibited.
  • These requirements fully apply to orders for the transportation of goods by the Service User, with the exception of restrictions related to the transportation of bulky goods.
  • The driver may set other restrictions for items for courier delivery or transportation.

The User is aware and confirms that in case of non-compliance with the above requirements, he is solely responsible for all the negative consequences that may occur in the process of providing services by Drivers. At the same time, the Drivers have the right to refuse the User to provide the service in case of detection of items that are not subject to transfer for transportation or delivery.

3. Cashless payment function

3.1. Payment for the transportation of passengers and / or other services, including courier delivery, can be made in the following way:

3.1.1. Cash - Directly to the Driver and / or Service Provider (in cash or by other means provided to the specified Driver, if any, the Service interface indicates - "Cash") by the User or the person in respect of whom the User places through the Service information about the potential demand for passenger transportation services and/or other services.

The specified type of payment is carried out without the participation of FOXIZZ and is not governed by these Terms.

3.1.2. Non-cash - Non-cash payment from a bank card (clause 3.2. of these Terms); in this case, FOXIZZ acts on behalf of the relevant Driver and/or Service Provider with the involvement of an authorized payment acceptance operator, or an electronic money operator, or other participants in settlements, information technology interaction, and is the payee as an agent of the Driver and/or Provider services (hereinafter referred to as “non-cash payment”).

FOXIZZ does not guarantee the absence of errors and failures in the operation of the Service regarding the provision of the possibility of cashless payment.

3.2. The linked bank card can be specified by the User in the interface of the Service, while the User specifies the following data:

  • Bankcard number
  • Valid until
  • security code

If the bank card details are correct, valid, and the use of this card within the Service is technically possible, the specified bank card acquires the status of Linked and can be used for non-cash payments (clause 3.1.2 of these Terms). All Linked Cards are displayed in the Service interface; for the convenience of the User, in relation to the Linked Card, the last 4 digits of the Linked Card number are displayed.

3.3. When adding the Linked Card, as well as if the User selects the function of non-cash payment for a specific trip, the amount is debited within 5 rubles, which is necessary to confirm the accuracy and validity of the data of the Linked Card; in case of successful completion of the transaction, the specified amount is returned to the User. An unsuccessful attempt to debit the specified amount means that the Linked Card cannot be added and/or the cashless payment function is unavailable, respectively.

3.4. FOXIZZ does not have access to the bank card data specified by the User and is not responsible for the safety and confidentiality of the transmitted data when making a cashless payment. Non-cash payment is carried out by the User with the participation of an authorized operator for receiving payments, or an operator of electronic money, or other participants in settlements, information technology interaction, and is regulated by the rules of international payment systems, banks (including the issuing bank of the Linked Card) and other participants in settlements .

3.5. When specifying his data in accordance with clause 3.2 of these Terms and further using the Linked Card, the User confirms and guarantees that he provides accurate and complete information about a valid bank card issued in his name; compliance with the rules of international payment systems and the requirements of the issuing bank that issued the Linked Card, including with regard to the procedure for conducting cashless payments.

3.6. If the User does not agree with the fact and / or amount of non-cash payment and for other issues related to the use of the Linked Card within the Service, the User has the right to contact FOXIZZ. Service by the phones indicated by the Service and / or through the interface of the support service (feedback) within 14 days from the date of the non-cash payment or other actions or events that caused the appeal.

If, based on the results of the verification on such an appeal, FOXIZZ decides to return the amount of non-cash payment in full or in part, the specified refund is made to the bank account of the bank card from which the non-cash payment was made. The procedure for the return of funds is carried out with the participation of an authorized operator for accepting payments or an operator of electronic money, or other participants in settlements, information technology interaction, and is regulated by the rules of international payment systems, banks (including the issuing bank of the Linked Card) and other participants in settlements .

3.7. FOXIZZ reserves the right at any time to require the User to confirm the data specified by him within the Service, including the data of the Linked Card, and to request in this regard supporting documents (in particular, identity documents), failure to provide which, due to discretion of FOXIZZ, may be equated to the provision of false information and entail the consequences provided for in clause 2.4 of these Terms.
